3. What Happens After a Notice
- We will review the notice for completeness and validity
- If valid, the identified content will be removed or disabled promptly
- We will notify the user who posted the content (the "alleged infringer") that their content has been removed and provide a copy of the takedown notice
- The alleged infringer may file a counter-notification (see below)
4. Counter-Notification
If you believe your content was removed in error or that you have the right to post it, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who filed the original takedown notice
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we will restore the removed content.
5. Repeat Infringer Policy
In accordance with the DMCA, NKP maintains a policy for terminating the accounts of users who are repeat infringers:
- First offense: Content removed, written warning issued
- Second offense: Content removed, final warning issued
- Third offense: Account permanently terminated
We reserve the right to terminate accounts after a single offense in egregious cases.
6. Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney's fees.
7. Non-Consensual Intimate Images (NCII)
For reporting non-consensual intimate images, please use our dedicated Report Content page. NCII reports are handled under the TAKE IT DOWN Act with a 48-hour removal deadline and do not require the DMCA process described above.
